Pre-launch draft. This page will be finalised before the shop opens.
Sales are not open yet. This is a pre-launch draft, not a current offer to sell. All purchase processes described below are planned and must be ready before checkout opens.
Who will sell to you
[LEGAL ENTITY NAME]
[REGISTERED ADDRESS]
[COUNTRY]
Our customer service address: help@prepouches.com. Telephone: [TELEPHONE NUMBER WITH COUNTRY CODE], [DAYS AND HOURS, TIME ZONE], charged at no more than a standard call rate. These details are placeholders pending confirmation. See Contact us for other enquiries.
These terms are intended to govern consumer purchases from PRE when sales open. Browsing is covered by our Terms of use. The version shown before a future order will apply to that order; a later website update will not retrospectively change it.
Ordering and contract formation
At launch you will be able to choose the flavour, strength and quantity, review the total and delivery details, correct mistakes and submit an order that clearly carries an obligation to pay. Until then, neither a preview bag nor a waitlist entry places an order or reserves stock.
Our proposed process is that your order is an offer to buy. An order-received email acknowledges receipt only. A contract is formed when we send a separate acceptance and dispatch confirmation identifying the accepted goods. If an order cannot be accepted, we will tell you and promptly release or refund any payment taken.
Prices and VAT
Prices for consumers in the EU and EEA are set in euros and include VAT: MILD EUR 10.99 and STRONG EUR 11.99 per tin of 20 pouches. Prices for consumers in the United Kingdom are set in pounds sterling and include UK VAT: MILD GBP 8.99 and STRONG GBP 9.99 per tin. [LAWYER: confirm the VAT route before launch. If PRE is registered for the EU One Stop Shop or Import One Stop Shop and for UK VAT, keep "include VAT". If not, replace with: "Prices do not include import VAT or duties, which the carrier may collect from you before delivery; the estimated amount is shown before you confirm your order."] [FOUNDERS: decide for Sweden, Denmark, Poland, Czechia, Hungary, Romania, Norway and Iceland whether the customer is charged the euro price or a fixed local-currency price; whichever figure is charged must be the figure shown on the product page.] The price shown on the product page for your delivery country is the price you pay for the goods, and it will not change at checkout. Delivery costs and any other applicable charge are shown separately, with the full total, before you confirm your order. Customs arrangements for deliveries outside the EU customs territory, including the United Kingdom, Norway and Iceland, are described in Delivery information. Where prices are shown for other currencies, they are converted from our US dollar prices for information only; they are not an offer to sell. Promotional codes are applied to the price shown on the product page at the time of your order; the conditions of each code are stated where it is offered.
If a pricing error is discovered before acceptance, we will explain it and ask whether you want to order at the corrected price. We will not charge an increased price without your agreement.
Payment
Payment processor: [PAYMENT PROCESSOR]. Accepted methods: [PAYMENT METHODS]. Payment authorisation and collection timing: [PAYMENT AUTHORISATION AND CAPTURE TIMING]. These will be confirmed before checkout is enabled.
No payment details are collected on the current site. Future payment handling will be described in the Privacy policy before it is used.
Delivery, risk and ownership
We plan to launch in the United Kingdom first, then Sweden, Ireland and Germany. See Delivery information for destinations, dispatch arrangements and charges. The order process will give you an agreed delivery date or period.
We remain responsible for the goods until you or your nominated recipient takes physical possession when we arrange the carrier. Our proposed ownership rule is that title passes once full payment is received. Passing ownership earlier does not transfer transit risk to you.
If we miss the agreed delivery time, contact us. Your rights may include setting an appropriate further deadline or ending the contract, including without an extra deadline where the law permits, and receiving the refund due.
Withdrawal and returns
Eligible distance purchases carry a 14-day right of withdrawal after delivery. See Right of withdrawal for notice, the model form, return deadlines and refund rules. See Returns and refunds for practical instructions.
The intended change-of-mind policy covers unopened, sealed tins. A hygiene exception is intended for tins unsealed after delivery, without removing rights for faulty or wrong goods.
Faulty goods and legal guarantees
Goods must conform to the contract. If you are a consumer in the EU or EEA you benefit from the legal guarantee of conformity under the law of the country where you live, for at least two years from delivery. If goods are faulty, damaged or not as described, contact us at help@prepouches.com. We will provide the remedy the law requires, which may include replacement, a price reduction or a refund, free of charge and with necessary return costs covered by us. These legal rights are separate from the 14-day right of withdrawal and from any commercial guarantee, and we do not make a commercial guarantee a condition of exercising them.
If you live in France. You benefit from the legal guarantee of conformity (Articles L.217-3 to L.217-20 of the Code de la consommation) for two years from delivery. A lack of conformity that appears within 24 months of delivery is presumed to have existed at delivery unless we prove otherwise. You may choose between repair and replacement; we may decline the option you choose only if it is impossible or would cost us disproportionately more than the other. The remedy must be provided within 30 days of your request, without major inconvenience and at no cost to you, including return costs. If we refuse, fail to act within 30 days, or the lack of conformity persists, you may ask for a price reduction or the cancellation of the sale with a full refund; cancellation is not available for a minor defect. You also benefit from the guarantee against hidden defects under Articles 1641 to 1649 of the Code civil: within two years of discovering the defect you may return the goods for a full refund or keep them for a partial refund. These guarantees apply regardless of any commercial guarantee.
Statutory notice for consumers in France (reproduced in French as required by Article D.211-2 of the Code de la consommation).
[Visibly boxed element containing, verbatim in French and copied from Légifrance on the day of publication, the goods box prescribed by Article D.211-2, with PRE's legal entity as "le vendeur".]
Lawyer review: confirm UK wording under the Consumer Rights Act 2015 (30-day short-term right to reject, six-month presumption) if UK sales go ahead.
Before sales open: publish a French-language version of the terms of sale, including the D.211-2 box.
Adults only
PRE is intended for adults aged 18+ and will only be sold to adults. Any higher applicable minimum age must also be met. The order process will explain the required age checks. Delivery checks may also apply where offered by the carrier.
Responsibility and liability
We are responsible to the extent required by applicable law for loss caused by our breach of contract or failure to take reasonable care. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or death or personal injury caused by negligence. Your mandatory consumer rights are unaffected.
Governing law and complaints
Proposed governing law: [GOVERNING LAW]. Proposed courts: [JURISDICTION]. Any choice of law or court remains subject to the mandatory protections and court rights available to consumers where they live.
Complaints and consumer mediation. Please write first to our customer service, help@prepouches.com, or to the postal address above. We aim to answer within [30] days. If you are a consumer and we have not answered within [60] days of your written complaint, or our answer does not satisfy you, you may refer the dispute free of charge to the consumer mediator we have appointed, who is referenced by the French Commission d'évaluation et de contrôle de la médiation de la consommation: [MEDIATOR NAME], [MEDIATOR POSTAL ADDRESS], [EMAIL], [MEDIATOR WEBSITE, including the online referral page]. Your referral must be made within one year of your written complaint to us, and the mediator may decline a dispute that has already been examined by another mediator or by a court. We will give you these details again in writing if we cannot resolve your complaint. The mediator also accepts cross-border disputes from consumers living in other EU and EEA countries; the European Consumer Centre network (eccnet.eu) can help with cross-border complaints. If you live in the UK, we will tell you on request whether we take part in an alternative dispute resolution scheme. Mediation is voluntary for you and does not remove your right to go to court.
